3.1 We sell:
original artworks, each a single unique piece;
prints and reproductions of artworks;
digital downloads; and
products created in collaboration with other artists or businesses ("Collaboration Products").
3.2 Original artworks and other handmade products carry natural variations in line, texture, colour and finish. These variations are part of the work and are not defects.
3.3 Product images are representative. Colours may appear differently depending on screen settings and lighting. Dimensions are approximate unless stated otherwise on the product page.
3.4 Some products are made to order after purchase. Production times are stated on the product page.
3.5 Collaboration Products may be produced or fulfilled by the collaborating party. Khutoot remains the seller of any Collaboration Product purchased through the Website. Any additional terms specific to a Collaboration Product are stated on its product page.
3.6 All products are subject to availability. If a product, including an original artwork, becomes unavailable after you have placed an order, we will notify you and refund the amount paid in full.
-
4.1 Prices are shown on the Website. You may select the currency in which prices are displayed and charged. Prices in currencies other than our base currency are converted at the rate applied by our e-commerce platform at the time of purchase. The amount charged is the amount shown at checkout in the selected currency.
4.2 Fees charged by your bank or card issuer for foreign currency transactions are your responsibility.
4.3 Khutoot is not registered for value added tax (VAT) yet in the UAE. Prices do not include UAE VAT.
4.4 Delivery charges are shown at checkout and are added to the product price unless stated otherwise.
4.5 Orders delivered outside the UAE may be subject to import duties, customs fees and taxes in the destination country. These are payable by the customer.
4.6 If a product is listed at an incorrect price because of an obvious error, we may cancel the order and refund the amount paid in full, including after order confirmation.
-
5.1 Placing an order is an offer to buy the products in your order. The order confirmation email acknowledges receipt of your order and is not an acceptance of it. A contract is formed when we send dispatch confirmation for physical products, or when a digital download is made available to you.
5.2 We may decline or cancel an order before it is accepted, including where a product is unavailable, a pricing error has occurred or we suspect fraud. Any amount paid for a declined or cancelled order is refunded in full.
5.3 Payment is taken at checkout through Stripe. Accepted payment methods are shown at checkout. We do not receive or store your full card details.
5.4 Payment must be received in full before a physical product is dispatched or a digital download is made available.
-
6.1 Delivery methods, timelines, charges and risk in transit are set out in our Shipping Policy.
6.2 Ownership of a physical product passes to you on delivery, provided payment has been received in full.
6.3 Cancellation before dispatch. You may cancel an order for a physical product at any time before it is dispatched by emailing layth@khutoot.art with your order number. Made-to-order products may be cancelled under this clause only before production has started. We refund cancelled orders in full.
6.4 Statutory cancellation rights. If you are a consumer and the law of your country of residence gives you a right to cancel a distance purchase, you may exercise that right within the period that law allows. Consumers in the United Kingdom may cancel within 14 days of delivery under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel, send a clear statement of your decision to layth@khutoot.art.
6.5 The following are excluded from statutory cancellation rights to the extent permitted by applicable law:
products made to your specifications or clearly personalised; and
digital downloads, once the download has begun with your consent (clause 6.8).
6.6 Where you cancel under clause 6.4, you must return the product within 14 days of notifying us, unused and in its original condition and packaging. Return costs are payable by you unless the product is faulty or incorrect. We refund the price paid and the original standard delivery charge within 14 days of receiving the product back or receiving proof of its return, whichever is earlier. We may deduct an amount for any reduction in the product's value caused by handling beyond what is needed to examine it.
6.7 Faulty, damaged or incorrect products. Notify us at layth@khutoot.art as soon as possible after delivery, with your order number and photographs of the product and packaging. We will repair, replace or refund the product. This clause does not limit any rights you have under applicable consumer law, including the UK Consumer Rights Act 2015.
6.8 Digital downloads. By completing the purchase of a digital download, you request immediate access to it and acknowledge that you lose any statutory right to cancel once the download begins. Digital downloads are non-refundable once downloaded unless the file is faulty or not as described.
6.9 Return instructions are provided by email on request.
6.10 Refunds are made to the original payment method in the currency of the original payment.

7.3 Without our prior written consent, you may not reproduce, copy, scan, adapt, create derivative works from or make commercial use of any product or any material on the Website. You may photograph a product you have bought and share those images for personal, non-commercial purposes, including on social media.
7.4 Khutoot may photograph, reproduce and display any work it has sold, including in its portfolio, on the Website and social media, and in publications and exhibitions. We do not disclose the buyer's identity without consent.
7.5 Digital downloads are licensed, not sold. On full payment, we grant you a non-exclusive, non-transferable licence to download, store and print the file for personal, non-commercial use. You may not:
resell, share, distribute or sublicense the file or any print made from it;
use the file or prints made from it in products or services offered for sale;
modify the file for any commercial purpose; or
use the file to train or develop artificial intelligence or machine-learning models.
7.6 Collaboration Products may include intellectual property owned by the collaborating party. Clauses 7.2 to 7.5 apply to that intellectual property in the same way.

8.2 We aim to keep the Website accurate and available but do not guarantee that it will be uninterrupted or free of errors.
8.3 Subscription to our newsletter is optional. You can unsubscribe at any time through the link in each email or by contacting us.
8.4 The Website may link to third-party websites. We are not responsible for their content or practices.
8.5 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded by law.
8.6 Subject to clause 8.5, we are not liable for any indirect or consequential loss, or for any loss of profit, business or opportunity. Our total liability in connection with an order is limited to the price paid for that order.
8.7 We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, government action, war, civil unrest, strikes, carrier failures and failures of utilities or communication networks.

9.1 We may update these Terms. The version published on the Website when you place an order applies to that order.
9.2 These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates as applied in Dubai.
9.3 The courts of the Emirate of Dubai (Dubai Courts) have exclusive jurisdiction over any dispute arising from or in connection with these Terms.
9.4 If you are a consumer resident outside the UAE, clauses 9.2 and 9.3 do not deprive you of the protection of mandatory consumer laws of your country of residence, or of any right under those laws to bring proceedings in the courts of that country.
9.5 If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full effect.
9.6 A delay or failure by us to enforce any provision does not waive our right to enforce it later.
9.7 We may transfer our rights and obligations under these Terms to another party. You may not transfer yours without our written consent.
9.8 No person other than you and Khutoot has any right to enforce these Terms.
9.9 These Terms are written in English. If they are translated, the English version prevails.
